In this book chapter, we study the preventive rule, raised in Ley 1333 de 2009, and the way that environmental law has been building its own rules; escaping from the administrative law and creating their own dogmatic, necessary to achieve its independence as a legal autonomous area. We also see that is possible to see how the preventive rule was designed out of the general theory of administrative act, because it has characteristics that make it unique in the Colombian legal (...) system. -/- En este capítulo se estudia la figura de la 'facultad a prevención' contenida en la Ley 1333 de 2009, para analizar la forma en la que el derecho ambiental ha venido construyendo una dogmática y reglas propias, escapando de la tradición del derecho administrativo, así como creando la dogmática propia necesaria para lograr su independencia y consolidación como un área autónoma de la disciplina jurídica. The boundary problem is related to the binding problem, part of a family of puzzles and phenomenal experiences that theories of consciousness (ToC) must either explain or eliminate. By comparison with the phenomenal binding problem, the boundary problem has received very little scholarly attention since first framed in detail by Rosengard in 1998, despite discussion by Chalmers in his widely cited 2016 work on the combination problem. However, any ToC that addresses the binding problem must also address the boundary problem. (...) The binding problem asks how a unified first person perspective (1PP) can bind experiences across multiple physically distinct activities, whether billions of individual neurons firing or some other underlying phenomenon. To a first approximation, the boundary problem asks why we experience hard boundaries around those unified 1PPs and why the boundaries operate at their apparent spatiotemporal scale. We review recent discussion of the boundary problem, identifying several promising avenues but none that yet address all aspects of the problem. We set out five specific boundary problems to aid precision in future efforts. We also examine electromagnetic (EM) field theories in detail, given their previous success with the binding problem, and introduce a feature with the necessary characteristics to address the boundary problem at a conceptual level. Topological segmentation can, in principle, create exactly the hard boundaries desired, enclosing holistic, frame-invariant units capable of effecting downward causality. The conclusion outlines a programme for testing this concept, describing how it might also differentiate between competing EM ToCs. (shrink)

Se lleva a cabo un planteamiento del estatus de la naturaleza en el ordenamiento jurídico como sujeto y objeto de derechos. Para lograr este objetivo, los autores se valen de una metodología inductiva a partir de un análisis descriptivo desde la doctrina, jurisprudencia y normas primarias. Con ello, se busca, en primer lugar, responder a la cuestión de si es posible o no que un ordenamiento jurídico contemple derechos de la naturaleza; en segundo lugar, se pretende evidenciar cómo el reconocimiento (...) de derechos sobre la naturaleza por parte de la jurisprudencia en Colombia cuenta con presupuestos comunes pese a que aún no se contemplan reglas claras sobre la asignación de derechos a la naturaleza. Al final, se realiza un llamado de atención para comprender esta figura más como un instrumento que el Estado debe utilizar a favor de la naturaleza, que como un decálogo de derechos. (shrink)

The stream of human consciousness appears to be interruptible, in that we can experience a sensation of ‘returning to ourselves after an absence of content’ (e.g. sleep, anaesthesia, full-absorption meditation). Prima facie, such evidence poses a challenge to simple applications of theories of consciousness based on electromagnetic or neural activity in the brain, because some of this activity persists during periods of interruption. This paper elaborates one of several possible responses to the challenge. We build on a previous theory in (...) which EM field topology delineates complex macrophenomenal experience. We first apply an analytic lens to identify different ways in which field topologies might generate sensations of ‘absence of content’. We then test the feasibility of a particular phenomenological approach for assessing those field topologies, powered by the unusual lucidity about cessation pathways induced via certain meditation practices and psychedelic dosages. We build computational simulations of these cessation pathways and test them on eight interviewees with various levels of experience in cessation states. We conclude that this approach can generate usable insight, but requires further formalisation to fulfil its potential. The findings tentatively support our claims but the theory remains speculative at this stage. We set out empirical tests with 11 specific predictions, both for further phenomenological research and for brain manipulation research. Although they align neatly, our ontological and cessation theories can also be separated. The paper describes how our theories can be consistent with other perspectives on consciousness, such as variants of predictive processing or global network theory. (shrink)

Una de las razones fundamentales por las cuales la muerte causa dolor se debe a una comprensión equívoca acerca del sentido último de la vida humana. Además, la Modernidad se desliga, en ocasiones, de la dimensión emotiva y afectiva del ser humano. Así pues, toda terapéutica del duelo mortuorio exige reflexionar con seriedad acerca del sentido de la muerte, tarea en la cual la tradición filosófica y teológica occidental es un apoyo ineludible. En la primera parte se ha de revisar, (...) desde la perspectiva filosófica de Epicuro, la concepción de la muerte según la cual la opinión ordinaria es errada y no da cabida a una vida realizada como fundamento de la tranquilidad y la salud. En la segunda parte se esbozarán los rasgos y las notas esenciales de una concepción cristiana de la muerte a partir de la obra de San Agustín de Hipona, exponiendo algunas medidas concretas de preparación para la muerte con base en su pensamiento. En este capítulo se analiza la figura de la obtención vegetal: su alcance, dimensión, requisitos y caracterización frente a otros derechos de propiedad intelectual, para así abordar su ámbito de protección y su tratamiento en el ámbito internacional. Se pretende en este sentido plantear que la tendencia regulatoria en materia de obtenciones vegetales en Colombia no sólo va en contravía de los intereses de los pueblos indígenas, sino además de su patrimonio colectivo que les ha garantizado una gran diversidad que (...) hoy por hoy es sustento de su alimentación. Con lo anterior se lleva a cabo un singular esfuerzo para tratar de forma comprensiva este asunto, buscando la primacía del consentimiento libre, previo e informado de las comunidades potencialmente afectadas. En el mundo académico contemporáneo han venido tomando fuerza, desde hace varias décadas, los temas de la interdisciplinariedad y la transdisciplinariedad, como respuesta de un sector de la comunidad científica a los problemas de la especialización y a la desconexión entre las ciencias. Como todo elemento o aspecto de la realidad, este tema requiere de una debida fundamentación filosófica que se encuentra en el pensamiento clásico. En el presente artículo se intenta mostrar la relación entre la tradición de la filosofía (...) perenne y este fundamento, atendiendo, sobre todo, a la importancia de la mirada holística del fenómeno ético y pretendiendo sustentar que el diálogo entre las ciencias sólo es posible rescatando el paradigma metafísico, legado por los griegos a la civilización occidental y defendido por MacIntyre en su libro "Ethics in the Conflicts of Modernity. En los últimos tiempos el derecho ambiental ha ganado un puesto importante en el ámbito jurídico, hecho que refleja la preocupación que hoy se tiene por la relación del hombre con su entorno. Desde hace quince años, la Universidad Colegio Mayor de Nuestra señora del Rosario, por intermedio de su Facultad de Jurisprudencia y concretamente de la Especialización y la línea de investigación en Derecho Ambiental, ha propuesto a través de diversos proyectos avanzar en el conocimiento y análisis del ordenamiento (...) jurídico ambiental, aportando así al desarrollo, estructura y consolidación de esta rama jurídica. Bajo estos parámetros, el objetivo de esta publicación es hacer algunas reflexiones en torno a distintos temas que dentro del derecho público impactan o influyen al derecho ambiental y responder a los enormes desafíos que se presentan en la materia. Por tanto, el programa quiere contribuir desde la academia al diálogo crítico y propositivo que permita dar solución a los problemas encontrados en la aplicación del derecho ambiental. En el primer capítulo, Gloria Amparo Rodriguez describe los ordenamientos jurídicos constitucionales de Colombia, Ecuador y Bolivia a fin de analizar la forma en que cada uno de ellos consagra el derecho a un ambiente sano. A continuación, Martha Ovalle y Zelba Nidia Castro de Perez realizan un estudio de los principios de precaución y prevención, exponiendo su alcance, su fundamento desde el derecho internacional y cómo vienen siendo entendidos por nuestro ordenamiento jurídico, tanto jurisprudencial como legal. Luis Adolfo Diazgranados se ocupa de la responsabilidad de los funcionarios públicos en materia ambiental, para lo cual realiza un análisis de los deberes consagrados en la normatividad vigente. Continuando con esta temática, el profesor Jorge Agudo Gonzalez, de la Universidad Autónoma de Madrid, explora la incidencia del ambiente y los recursos naturales en los procesos contractuales, a fin de mostrar cómo estas materias se han constituido en variable fundamental en el devenir de la formación, celebración y ejecución de los contratos, desde un punto de vista crítico, los aspectos importantes del proceso sancionatorio ambiental, evidenciando las falencias y vacios del a Ley 1333 de 2009. Jairo Cabrera plantea algunas reflexiones sobre la responsabilidad, valiéndose de la doctrina internacional, sobre la problemática de la reparación por daño ambiental. Por su parte, Leonardo Güiza Suárez explica el régimen general de la responsabilidad ambiental en el ordenamiento jurídico a partir del daño de los bosques naturales y su incidencia sobre los derechos humanos. Andres Gomez Rey, desde la teoría del acto administrativo, desarrolla el análisis crítico del régimen jurídico de las aguas superficiales en el derecho ambiental. Giovani J. Herrera Carrascal realiza una disertación sobre los recursos naturales y el ambiente como elementos del espacio público que a su vez constituye en un componente del medio ambiente urbano a partir de la jurisprudencia y de las competencias respectivas. Por último, Marybell Ochoa Miranda trate el tema de los residuos hospitalarios en Colombia, exponiendo su régimen jurídico, las competencias de las autoridades ambientales, los deberes que en estos asuntos tienen los ciudadanos, proponiendo lineamientos para avanzar en la consolidación de la gestión integral de residuos hospitalarios y similares. (Spanish) RESUMEN: La libertad absoluta postulada por Viktor Emil Frankl y Jean-Paul Sartre, la Shoah y la creencia en un dios omnipotente, bueno y justo parecen contradecirse. La pregunta por el sentido del sufrimiento de las víctimas del Holocausto (la verdadera catástrofe, el mayor crimen contra la humanidad), simbolizado por Auschwitz, y como punto de inflexión en la historia, es terriblemente dolorosa y parece no tener una respuesta filosófica ni teológica. A mi juicio, es importantísimo distinguir entre las víctimas inocentes (...) de la Shoah que perecieron y las víctimas inocentes que sufrieron un verdadero infierno y perdieron a sus seres queridos, pero que lograron sobrevivir. Ambas son víctimas, por supuesto, pero así como encontrarle un posible sentido al sufrimiento de las víctimas masacradas y gaseadas podría suponer un insulto a su sufrimiento y agonía –en especial, al horror que sufrieron los niños–, el horrible sufrimiento de los supervivientes pudo dar, tal vez, de alguna manera, un sentido a sus vidas después de la liberación de los campos de concentración y exterminio, ya fuera como voz, como protesta o como simple supervivencia. Frankl apuesta por un sentido último (que abraza el sentido del sufrimiento de las víctimas), y Sartre, aunque parezca no apostar por sentido alguno, volcó su vida al compromiso político después de la Segunda Guerra Mundial, y ello parece vislumbrar una minúscula pizca de sentido después de la barbarie. La filosofía de Frankl es un sí a la vida incluso en las situaciones más extremas, un grito casi nietzscheano que exalta el valor de la vida más allá de cualquier sufrimiento. Frankl, padre de la logoterapia y superviviente del Holocausto, abre una puerta a Dios al hablar de un dios inconsciente, una dimensión suprahumana y una fe incondicional, y define la religión como espiritualidad y como la búsqueda del hombre por el sentido último. Según Frankl, la libertad no se contradice con Dios, y la religión existe no a raíz de la barbarie, sino a pesar de la barbarie. El existencialismo sartreano es una filosofía de la libertad radical y de la responsabilidad. El hombre está condenado a ser libre. El ser humano es un ser en el que la existencia precede a la esencia. Somos totalmente responsables de lo que somos. Sartre afirma que la libertad humana es incompatible con Dios. En un mundo sin Dios, la moral la construyen los hombres, con sus propias decisiones y sus acciones, y la existencia y el sufrimiento de las víctimas no tienen sentido alguno. Sartre define al hombre como libertad, responsabilidad, angustia y contingencia. Frankl define al hombre como libertad, responsabilidad, espiritualidad y búsqueda de sentido. Con esta tesis me propongo entrar en la resbaladiza dimensión del dolor, la desesperación, el sentido y sinsentido del sufrimiento de las víctimas (teniendo presente los horrores de Auschwitz, que en teología y filosofía ha simbolizado desde la liberación de los campos la muerte de Dios y la muerte de la moral). Es verdad que no solo los hombres, mujeres y niños judíos fueron víctimas de la barbarie alemana, pero, como reza el mensaje de Elie Wiesel en la exposición permanente del Block 27 del Auschwitz-Birkeanu State Museum: "Not all victims were Jewish in this place, but all Jews were victims". La Shoah no es un episodio dentro de la Segunda Guerra Mundial, sino un punto de inflexión en la historia de la humanidad, y es una catástrofe que nos concierne a todos, hombres y mujeres judíos y no judíos, religiosos e irreligiosos, creyentes e increyentes, como seres libres, responsables y morales que somos –o que deberíamos ser. Muchas de las víctimas del Holocausto, en medio de la desesperación, entraron en las cámaras de gas orando, aferrándose a la esperanza de que ese final espeluznante no era un punto final. Con esta tesis no me propongo de ninguna manera responder a la eterna pregunta de si Dios existe o no, sino que propongo interpretar ese grito hacia Dios como un desesperado anhelo de esperanza. También me propongo encontrar una coherencia en las posturas de estos dos grandes pensadores para quienes la libertad y la responsabilidad definen al hombre: Frankl (quien apuesta por una dimensión suprahumana donde existe un sentido último en el que el sufrimiento de las víctimas tiene que tener algún sentido, aunque ese sentido sea completamente incomprensible en la dimensión humana) y Sartre (el existencialista ateo por excelencia, para quien el mundo, la existencia y el sufrimiento son absolutamente contingentes). En el primer capítulo expongo la logoterapia y el existencialismo sartreano: describo las tres dimensiones del hombre y las tres búsquedas de sentido propuestas por Frankl, y expongo las cinco consecuencias de "l'existence précède l'essence", centrándome en la libertad y la responsabilidad, y hablo del suicidio. El segundo capítulo está dedicado al dios inconsciente frankleano, la dimensión suprahumana, la búsqueda por el sentido último y la fe incondicional. En el tercer capítulo ilustro la libertad sin Dios sartreana, la ontología sartreana, el ateísmo sartreano y el humanismo sartreano, y hablo sobre la responsabilidad, la mauvaise foi, la contingencia, la situation y la angustia. El cuarto capítulo es necesariamente histórico (sin dejar de ser filosófico): me pregunto por la muerte de Dios después de Auschwitz, argumento y defiendo la unicidad del Holocausto (la Shoah es un punto de inflexión en la historia de la humanidad), describo las masacres antes de los campos de exterminio (Einsatzgruppen, Ordnungspolizei y Wehrmacht), el gigantesco complejo de Auschwitz (Stammlager, Auschwitz-Birkenau y Monowitz-Buna), reflexiono sobre Dios y el mal (centrándome en los niños de Auschwitz), describo los días de Frankl en Auschwitz, hablo de Dios como esperanza, de la inmortalidad y la escatología, de la crueldad de Dios, de la relación entre el cristianismo y el antisemitismo, del islam y el antisemitismo, critico el silencio de Dios, hablo de la muerte de Dios y del juicio contra Dios. En el quinto capítulo expongo la moral frankleana (una moral que atañe al hombre y no a Dios), basándome en su teoría del amor y en su única obra de teatro (Synchronisation in Binkerwald), y la moral sartreana (una moral que atañe a una humanidad sin Dios), recordando a Dostoyevsky, analizando la famosa cita de Garcin en Huis clos "L'enfer, c'est les Autres", criticando el marxismo de Sartre y cuestionando (con la mirada de Frankl y Sartre) el verso de Brecht "Erst kommt das Fressen, dann kommt die Moral"; al final del capítulo incluyo una reflexión propia y las críticas frankleana y sartreana sobre la impunidad de los verdugos y colaboradores después del Holocausto (con el permiso de Dios). The question of the meaning of the victims' suffering of the Holocaust (the true catastrophe, the biggest crime against humanity), simbolised by Auschwitz and as a turning point in History, is terribly painful and doesn't seem to have an answer. In my opinion, it's crucial to distinguish between the innocent victims of the Shoah who perished and the innocent victims who sufferend a real hell and lost their loved ones, but managed to survive. Both are victims, of course, but just as finding a possible meaning to the suffering of the massacred and gassed victims could result in an insult to their suffering and agony –especially to the horror that the children suffered– the gigantic suffering of the survivors could, maybe, somehow, give a meaning to their lives after the liberation of the concentration and extermination camps, either as a voice, as a protest, or as a simple survival. Frankl believes in an ultimate meaning (that embraces the meaning of the victims' suffering), and Sartre, even if it appears not to embrace any meaning, turned his life to political engagement after War World II, and that attitude seems to give a tiny glimpse of meaning after the barbarity. Frankl's philosophy says yes to life even in the most extreme situations, and it's a Nietzschean-like scream that exalts the value of life beyond any monstrous suffering. Frankl, the father of logotherapy and a Holocaust survivor, opens a door to God when he talks about an unconscious God, a supra-human dimension and an unconditional faith; he defines religion as spirituality and as man's search for ultimate meaning. According to Frankl, freedom is not contradictory with God, and religion exists not because of the barbarity but in spite of the barbarity. Sartrean existentialism is a philosophy of radical freedom and responsibility. Men are condemned to be free. We are beings where the existence precedes the essence. We are completely responsible of what we are. Sartre argues that human freedom is incompatible with God. In a godless world, morality is constructed by people, with their own choices and actions, and human existence and the suffering of the victims don't have any meaning. Sartre defines man as freedom, responsibility, Angst and contingency. Frankl defines man as freedom, responsibility, spirituality and search for meaning. With this dissertation I attempt to enter in the slippery dimension of the pain, despair, meaning and meaninglessness of the victims' suffering (having in mind the horrors of Auschwitz, that in theology and in philosophy have simbolised, since the liberation of the camps, the death of God and the death of morality). It's true that not only Jewish men, women and children were victims of the German barbarity, but, as Elie Wiesel's message from the permanent exhibition from Block 27 of the Auschwitz-Birkeanu State Museum reads: "Not all victims were Jewish in this place, but all Jews were victims". The Shoah is not an episode inside War World II, but a turning point in the history of humankind, and a catastrophe that embraces us all, Jewish and not not Jewish men and women, religious and not religious, believers and not believers, as the free, responsible and moral beings that we all are –or that we should be. A lot of the victims, in the midst of their desperation, entered into the gas chambers praying, holding to the hope that their horrifying end was not the ultimate end. With this dissertation I do not attempt to answer the eternal question of the existence of God, rather, I will try to interpret that scream to God as a longing for hope. I also intend to find a coherence between the thought of these two great thinkers for whom freedom and responsibilty define man: Frankl (who argues that there is a suprahuman dimension where an ultimate meaning exists and where the victims' suffering has to have a meaning, even if this meaning is completely incomprehensible in the human dimension) and Sartre (the atheist existentialist par excellence, for whom the world, human existence and suffering are absolutely contingent). In the first chapter I expose logotherapy and Sartrean existentialism: I describe the three dimensions of man, the three searches for meaning, the five consequences of "l'existence précède l'essence" and I speak about suicide. The second chapter delves into the unconscious God, the supra-human dimension, the ultimate meaning and the unconditional faith. In the third chapter I expose the freedom without God defended by Sartre, Sartre's ontology, Sartre's atheism, Sartre's humanism, and his ideas about responsibility, mauvaise foi, contingency, situation, and Angst. The fourth chapter is necessarily historical (while being philosophical too): I wonder about the death of God after Auschwitz, I argue and defend the uniqueness of the Holocaust (the Shoah is a turning point in the history of humankind), I describe the massacres before the extermination camps (Einsatzgruppen, Ordnungspolizei y Wehrmacht), the gigantic Auschwitz camp complex (Stammlager, Auschwitz-Birkenau y Monowitz-Buna), I reflect on God and evil (focusing on the children of Auschwitz), I describe Frankl's days in Auschwitz, I talk about God as hope, about immortality and escathology, I discuss God's cruelty, the relationship between Christianity and antisemitism and Islam and antisemitism, I question the silence of God, and I talk about the death of God and about the trial against God. In the fifth chapter I talk about the Franklean morality (a morality that concerns man and not God), on the basis of his love theory and his only work of theater (Synchronisation in Binkerwald), and the Sartrean morality (a morality that concerns a humanity without God), remembering Dostoyevsky, analysing Garcin's famous quote in Huis clos "L'enfer, c'est les Autres", crticizing Sartre's marxism and questioning (with Frankl's and Sartre's eyes) Brecht's verse "Erst kommt das Fressen, dann kommt die Moral"; at the end of the chapter I include my own reflection (and Frankl and Sartre's critique) about the impunity of the executioners and collaborators after the Holocaust (with God's permission). After the Conclusion, I add an Appendix about the lives of Frankl and Sartre, which helps understanding better their work. The Extended Evolutionary Synthesis (EES) debate is gaining ground in contemporary evolutionary biology. In parallel, a number of philosophical standpoints have emerged in an attempt to clarify what exactly is represented by the EES. For Massimo Pigliucci, we are in the wake of the newest instantiation of a persisting Kuhnian paradigm; in contrast, Telmo Pievani has contended that the transition to an EES could be best represented as a progressive reformation of a prior Lakatosian scientific research program, with the extension (...) of its Neo-Darwinian core and the addition of a brand-new protective belt of assumptions and auxiliary hypotheses. Here, we argue that those philosophical vantage points are not the only ways to interpret what current proposals to ‘extend’ the Modern Synthesis-derived ‘standard evolutionary theory’ (SET) entail in terms of theoretical change in evolutionary biology. We specifically propose the image of the emergent EES as a vast network of models and interweaved representations that, instantiated in diverse practices, are connected and related in multiple ways. Under that assumption, the EES could be articulated around a paraconsistent network of evolutionary theories (including some elements of the SET), as well as models, practices and representation systems of contemporary evolutionary biology, with edges and nodes that change their position and centrality as a consequence of the co-construction and stabilization of facts and historical discussions revolving around the epistemic goals of this area of the life sciences. We then critically examine the purported structure of the EES—published by Laland and collaborators in 2015—in light of our own network-based proposal. Finally, we consider which epistemic units of Evo-Devo are present or still missing from the EES, in preparation for further analyses of the topic of explanatory integration in this conceptual framework. Contemporary evolutionary biology comprises a plural landscape of multiple co-existent conceptual frameworks and strenuous voices that disagree on the nature and scope of evolutionary theory. Since the mid-eighties, some of these conceptual frameworks have denounced the ontologies of the Modern Synthesis and of the updated Standard Theory of Evolution as unfinished or even flawed. In this paper, we analyze and compare two of those conceptual frameworks, namely Niles Eldredge’s Hierarchy Theory of Evolution (with its extended ontology of evolutionary entities) and (...) the Extended Evolutionary Synthesis (with its proposal of an extended ontology of evolutionary processes), in an attempt to map some epistemic bridges (e.g. compatible views of causation; niche construction) and some conceptual rifts (e.g. extra-genetic inheritance; different perspectives on macroevolution; contrasting standpoints held in the “externalism–internalism” debate) that exist between them. This paper seeks to encourage theoretical, philosophical and historiographical discussions about pluralism or the possible unification of contemporary evolutionary biology. (shrink)

ABSTRACT: Almost all the voices of the six million Jewish men, women, and children who perished in the Holocaust were shuttered in the massacres of the Einsatzgruppen and inside the gas chambers (and vans) of the six German extermination camps (Auschwitz-Birkenau, Treblinka II, Bełżec, Sobibór, Chełmno, and Majdanek). Some of the victims' writings and drawings have survived, and these testimonies remain today a fraction of the millions of voices that were lost forever. With this paper I would like to convey (...) the idea that the (reconstructed and often fictionalized) voices that can be found in Holocaust feature films represent a homage to the victims who perished, and that these films (independently of their commercial success or their minor historical errors) often bring knowledge about the victims' suffering, antisemitism, the ghettos, the transports, the massacres, the Vernichtungslager and the Konzentrationslager to the vast public, and represent a glimpse into the shuttered voices of the Shoah. I also argue that, approached with caution, Holocaust films (antisemitic German propaganda films, post-war documentaries and post-war feature films) can be a valuable contribution to the historiography of the Shoah. El retorno del lenguaje conlleva la desaparición del hombre como figura cardinal del saber moderno. La historia es discontinua. Foucault dudó de las verdades de cada época y de las verdades intemporales. En este artículo trazo el recorrido del hombre en Les mots et les choses, mostrando la tensión entre el lenguaje y la desaparición del hombre, hablo de la discontinuidad (...) de la historia y los “jeux de vérité”, y muestro que Foucault se consideraba, por encima de todo, un pensador escéptico. / ABSTRACT: The death of man proclaimed by Foucault is in close relationship with the death of God proclaimed by Nietzsche. The return of language is linked with the disappearance of man. History is discontinuos. Foucault doubted the truths of each era as well as the timeless truths. In this article I present man’s journey in Foucault’s Les mots et les choses, showing the tension between language and the disappearance of man, I talk about historical discontinuity and the “jeux de vérité”, and I argue that Foucault considered himself, above all, a skeptical thinker. Stravinsky considered himself a maker, a Homo faber, an artisan of the past. He confessed that he liked to compose music more than music itself, and argued that expression was not an immanent character of music. With this paper, I intend to discuss Stravinsky’s musical aesthetics (the Charles Eliot Norton Lectures given right after the outbreak of WWII –Poétique musicale), depicting and criticising his notion of expression and his view of the musician as mere “executant”. I will also point out (...) some biographical details (the controversial premiere of Le Sacre du printemps and Stravinsky’s antisemitism) while criticising Adorno’s harsh critique of Stravinsky’s music. -/- . El artículo aborda el problema de la relación entre el ser humano y la técnica en el mundo actual desde una perspectiva filosófica. Volver a la concepción de la filosofía griega permite concebir hoy el quehacer filosófico como un ejercicio vital, sin fracturas entre el pensamiento y la acción. La patente plasticidad del ser humano evidencia la constitutiva apertura que determina su especificidad y, además, columbra la estrecha vinculación entre técnica, creación y cuidado a partir del acontecimiento del habitar. El (...) cuidado no puede tener lugar sin cierta promoción de un ethos cultural centrado en el miramiento, la asistencia y la preocupación por uno mismo y por el Otro. El olvido de la relación entre la creación y el cuidado conduce a un desequilibrio ethopoiético entre la condición ontológica del ser humano, como ser nacido, finito y vulnerable, y el desarrollo tecnológico, impulsado por la digitalización de la vida y el ascendente papel de las nuevas tecnologías en la sociedad. Advertir y remediar dicho desequilibrio supone repensar la originaria relación entre la creación técnica y el cuidado ético, así como la importancia de la ética para la persistencia de lo orgánico. De ce a fost fondată Uniunea Europeană? Un prim răspuns ar fi dorinţa de pace după un război devastator şi umilitor. Un al doilea răspuns ar fi realizarea importanţei unităţii. O unitate care se va caracteriza printr-o diversitate a culturilor şi a limbilor. Statele europene nu au dorit să renunţe la suveranitatea lor, au vrut să devină un corp comun pentru a nu a mai putea fi călcate în picioare de iureşul istoriei. Ca orice unitate, UE avea nevoie de un (...) cadru de reglementare oferit de instituţii şi politici europene. De asemenea, pentru a armoniza ceva trebuie să poţi pune împreună anumite elemente separate. Armonizarea Uniunii a fost realizată prin fondarea instituţiilor şi a reglementărilor acestora (structura instituţională a UE este prezentată în Anexa nr. 1). Instituţionalizarea Uniunii Europene este cheia de boltă a construcţiei istorice europene. Început în anul 1957, acest proces a lăsat urme adânci în conştiinţa politică europeană. Dacă la început a fost privită cu reticenţă, acum Uniunea nu poate exista fără instituţii. (shrink)

Two competing accounts of value incomparability have been put forward in the recent literature. According to the standard account, developed most famously by Joseph Raz, ‘incomparability’ means determinate failure of the three classic value relations ( better than , worse than , and equally good ): two value-bearers are incomparable with respect to a value V if and only if (i) it is false that x is better than y with respect to V , (ii) it is false that x (...) is worse than y with respect to V and (iii) it is false that x and y are equally good with respect to V . Most philosophers have followed Raz in adopting this account of incomparability. Recently, however, John Broome has advocated an alternative view, on which value incomparability is explained in terms of vagueness or indeterminacy . In this paper I aim to further Broome’s view in two ways. Firstly, I want to supply independent reasons for thinking that the phenomenon of value incomparability is indeed a matter of the indeterminacy inherent in our comparative predicates. Secondly, I attempt to defend Broome’s account by warding off several objections that worry him, due mainly to Erik Carlson and Ruth Chang. (shrink)

Niche construction is the process of organisms changing themselves or their environment—or their relationship with their environment—in ways that affect the evolutionary trajectory of their population. These evolutionary trajectory changes are traditionally understood to be triggered by changes in selection pressures. Niche construction thus necessarily involves organisms altering selection pressures. In this paper, we argue that changes in selection pressures is not the only way organisms can influence the evolutionary futures of their population. We propose that organisms can also affect (...) drift probabilities, and that such changes should be considered niche construction. Drift probabilities can be modulated by altering population size or by affecting driftability (individual variance in possible reproductive outcomes). We consider both and provide examples of how niche construction can stabilize, increase, or dampen drift probabilities. Finally, we revisit and broaden the traditional definition of niche construction. We hold that organismic activities that modify drift probabilities should count as niche construction, even if selection pressures remain unaltered. (shrink)

Background: The internationalization of clinical studies requires a shared understanding of the fundamental ethical values guiding clinical studies. It is important that these values are not only embraced at the legal level but also adopted by clinicians themselves during clinical studies. Objective: Our goal is to provide an insight on how clinicians in Germany and Poland perceive and identify the different ethical issues regarding informed consent in clinical studies. Methods: To gain an understanding of how clinicians view clinical studies in (...) the countries they work in, we carried out semi-structured problem-centered interviews per telephone in Poland (n = 6) and Germany (n = 6). Our interviewees concentrated on three main topics: an appraisal of the normative framework, challenges in the information process and the protection of all participants in clinical studies. Results: Clinicians generally supported the normative framework, even though they considered it quite complex. In the two study countries, a widely noted dilemma in the information process was whether to overburden participants with extensive information or risking leaving out important facts. Clinicians were ready to exclude larger population groups from participating in clinical studies when the information process could not be carried out with standard procedures or when their inclusion was ethically sensitive. Conclusion: Clinicians need to gain a better understanding of the consequences of excluding larger population groups form participating in clinical studies. They should seek assistance in improving the information process for the inclusion of underrepresented groups in clinical studies. (shrink)

We are already past the point where climate change mitigation alone does not suffice and major efforts need to be undertaken to adapt agriculture to climate change. As this situation was both foreseeable and avoidable, it is urgent to see that particularly people who have historically contributed the least to climate change do not end up assuming most of the costs. Climate change will have the worst effects on agriculture in the tropical region in the form of droughts, extreme heat (...) waves and massive storms. The historical unequal contributions to climate change and its unjustly distributed consequences morally oblige us to distribute global adaptation costs fairly. Yet to have a full understanding of the social implications of adapting to climate change we need to look beyond making adaptation technologies accessible and available. Using a social justice framework, I defend fair prices of adaptation technologies as a demand of justice in exchange, an allocation of research attention proportional to urgent global needs as distributive justice, inclusive technology development and governance as contributive justice and addressing the interests of future generations as intergenerational justice. Extreme inequality of opportunity leads to a number of social tensions, inefficiencies and injustices. One issue of increasing concern is the effect inequality is having on people’s fair chances of attaining meaningful work, thus limiting opportunities to make a significant positive contribution to society and reducing the chances of living a flourishing life and developing their potential. On a global scale we can observe an increasingly uneven provision of meaningful work, raising a series of ethical concerns that need detailed examination. (...) The 20th century was a bloody one, full of armed clashes which destroyed Europe, withered an entire generation’s hope of European-level peace. After the Versailles Treaty, the famous economist John Maynard Keynes uttered this prophecy: ”With such a peace treaty, you’ll be at war again within 20 years”. John Maxwell Coetzee, an important South-African novelist, called the 20th century “Satan’s century”. A tough statement yet extremely true unfortunately. Besides war, the past one hundred years also witnessed terrible totalitarian regimes occur, (...) such as the Nazi and fascism. The hardness of those regimes at least equaled the suffering caused by the world wars. One wouldn’t be wrong to call such regimes state terrorism: a leader suppressing his own citizens just to satisfy his own fantasy. The hugeness of their deeds goes beyond human imagination according to the number of victims. A classical word of wisdom describes terrorism as follows: ”It kills a few, but terrifies more”. Kitcher has proposed an ideal-theory account—well-ordered science (WOS)— of the collective good that science’s research agenda should promote. Against criticism regarding WOS’s action-guidance, Kitcher has advised critics not to confuse substantive ideals and the ways to arrive at them, and he has defended WOS as a necessary and useful ideal for science policy. I provide a distinction between two types of ideal-theories that helps clarifying WOS’s elusive nature. I use this distinction to argue that the action-guidance problem that WOS faces (...) remains even under the aims/means distinction, because the WOS’s failure is more basic than critics have suggested. Our main objective is to locate and analyze some philosophical issues about the concept of mental illness and the manner it is used, especially in contemporary psychiatry. It is even difficult to find a standard meaning in the main psychiatric textbooks; and, when there is some exposition of the concept, it is sparse, uncritical and vague. As an immediate consequence of these issues, practical guidelines and protocols for the clinic arise, which become almost “automatic”, unreflective behaviors, practices translated as health (...) interventions and public mental health policies. An example is the problem of overdiagnosis, in which the use of medical technology (categories, drugs, clinical exams, etc.) has generated more harm and risks to the subject's health than benefits. Exposing these issues from a philosophical perspective can eventually contribute to the field of mental health. For this work, the main manuals and textbooks of psychiatry were selected to analyze how they deal with the concept of mental illness or disorder, in addition to locating the present discussion in authors from both philosophy and the psychiatric field and how they contribute to its clarification. RESUMEN: Viktor Frankl es el pensador del sentido y de la esperanza. Superviviente del Holocausto, perdió a sus padres, a su hermano y a su mujer en la Shoah. Frankl jamás se rindió al desaliento y apostó por ser optimista a pesar de la tríada trágica de la vida (el sufrimiento, la culpa y la muerte). Su tesis es un sí a la vida con mayúsculas: el ser humano es un ser en busca de sentido, y la vida siempre tiene (...) sentido, bajo cualquier circunstancia. Esta bella tesis es, sin embargo, un tanto problemática en un escenario tan espeluznante como la Shoah. Frankl define al ser humano como libertad, responsabilidad, espiritualidad y búsqueda de sentido. El presente artículo expone la logoterapia bajo una perspectiva filosófica, incluye un recorrido histórico-biográfico desde el Anschluss hasta la liberación, reflexiona sobre la búsqueda por el sentido y el sentido del sufrimiento, y muestra cómo algunas de las tesis de Frankl pudieron ayudar a algunas víctimas en los campos de concentración alemanes (jamás en los campos de exterminio alemanes ni en las masacres de los Einsatzgruppen) y cómo pueden ser un antídoto contra la desesperación y el suicidio. /// -/- ABSTRACT: Viktor Frankl is the thinker of meaning and hope. He was a Holocaust survivor and lost his parents, his brother and his wife in the Shoah. Frankl never surrendered to hopelessness and committed to optimism despite the tragic triad of life (suffering, guilt and death). His thesis is a yes to life in capital letters: human beings are beings in search of meaning, and life always has meaning, whatever the circumstances. This beautiful thesis is, nevertheless, a bit problematic in a gruesome scenario such as the Shoah. Frankl defines human beings as freedom, responsibility, spirituality and search for meaning. The present paper discusses logotherapy from a philosophical perspective, includes a historical-biographical note since the Anschluss until the liberation, reflects on the search for meaning and the meaning of suffering, and shows how some of Frankl's thesis may have been useful to some victims in the German concentration camps (never in the German extermination camps or in the massacres of the Einsatzgruppen) and how they can be an antidote against despair and suicide. According to a bits generation technique, that is, bits can only take a binary value of 0 in the absence of wave function collapse and 1 when wave function collapse occurs, that is, regardless of the value random in which the collapse of the wave function occurs that in the past caused the development of an alternative technique of classic bits to be renounced and remains currently an impossibility in normal science, through series of quantum entanglements, using BCD, EBCDIC or (...) ASCII coding standard in computing, data are teleported surpassing c, from a sender to a receiver, theoretically placed at any distance. This technique is a new discovery with theoretical foundation in the work “Superluminal Data Transmission supported by Quantum Entanglement” (1) by this author, stored, since April 2023, as a preprint, in the ResearchGate, and Philpapers repositories, and pending implementation by communications engineering in a longterm future. In this work it is unequivocally established that the maximum speed c for this type of transmission is false, causing critical break with Relativity. This new technique, unlike the one presented in my previous paper, it is a version much simpler that can be implemented according to the current state of technology, so at present the instantaneous transmission of information can be tested experimentally. Are widely used measurements in the human sciences (say happiness surveys or depression scales) quantitative or merely ordinal? If they are merely ordinal, could they be developed into quantitative measurements, just like in the progression from thermoscopes to thermometers? Taking inspiration from recent philosophy of measurement, some practitioners express optimism about future human science measurements. The so-called quantity objection stands out for having the only chance of settling the debate in favour of the pessimists. It claims that the problem lies (...) not with current, or likely future, measurement practices in the human sciences, but with human science attributes themselves—they just are not quantitative, but merely ordinal. Hence, they cannot not (thus will not) be measured quantitatively. The argument has a long and distinguished pedigree. This paper assesses old and recent versions of it, namely: the objection made originally to Fechner’s psychophysics by von Kries (among others) and Michell’s recent version of this objection. To do so, the paper first draws important distinctions between different versions of the argument that have been overlooked. Then, it argues that none of the versions of the quantity objection provide a good reason for the optimists to give up their optimism. In particular, Michell’s argument characterizes the measurand (that is, the attribute to be measured) in a way that optimists do not and need not accept. Yet the optimists’ defence articulated here brings with it serious burdens to discharge. The ball is in their court. (shrink)

Recent studies demonstrate a moral self effect: continuity in moral values is crucial to ascriptions of identity in and over time. Since Locke, personal identity has been referred to as a ‘forensic’ concept, meaning that it plays a role in attributions of moral responsibility. If moral values are crucial to identity over time, then perceived changes in a person’s set of values may reduce responsibility for past deeds. To test this, we examined the moral self effect in parole contexts. In (...) this empirical article, we conducted two experiments, in which participants were significantly more likely to grant parole to agents who underwent a moral change as opposed to mere behavioral change. We conclude by discussing possible objections and implications of these philosophical results for the Lockean view of personal identity. -/- . (shrink)

As populations grow and arable land becomes increasingly scarce, large-scale long- term land leases are signed at a growing rate. Countries and investors with large amounts of financial resources and a strong agricultural industry seek long-term land leases for agricultural exploitation or investment purposes. Leaders of financially poorer countries often advertise such deals as a fast way to attract foreign capital. Much has been said about the short-term social costs these types of leases involve, however, less has been said about (...) the normative dimension of their long-term environmental impact. We therefore will focus on the likely impact such deals have for soil conservation, by (1) briefly introducing the basics of long-term leasing arrangements by comparing land leases to the renting of buildings, (2) explaining from a soil sciences perspective the difficulties in assessing the current value of an estate and in calculating the damages of soil erosion and degradation, and (3) show how difficult it is to incentivize the conservation of soil quality when one cannot sufficiently and cost-effectively valorize existing environmental capital and eventual future damages. Attempting to oblige tenants through contracts to invest in sustainable stewardship has limited potential when liability payments do not reflect true costs and are hard to enforce. (shrink)

The concept of food sovereignty is becoming an element of everyday parlance in development politics and food justice advocacy. Yet to successfully achieve food sovereignty, the demands within this movement have to be compatible with the way people are pursuing consumer sovereignty, and vice versa. The aim of this article is to examine the different sets of demands that the two ideals of sovereignty bring about, analyze in how far these different demands can stand in constructive relations with each other (...) and explain why consumers have to adjust their food choices to seasonal production variability to promote food sovereignty and so secure future autonomy. In this article, I focus on the problem of body as it is developed in Heidegger’s Zollikon Seminars, in contrast with its enigmatic concealment in Being and Time. In the first part, I emphasize the implicit connection of Heidegger’s approach of body with Husserl’s problematic of Leib and Körper, and with his phenomenological analyses of tactility. In the second part, I focus on Heidegger’s distinction between the limits of the lived body and the limits of the corresponding corporeal thing, opening (...) to an ontological understanding of the ecstatic bodying forth of the body. In the third part, I analyse this ecstatic bodiliness in relation to the problem of spatiality, exploring the tension between the here and the over there in the experience of the embodiment. Heidegger not only refuses to understand the space starting from the here of the body, but he also refuses to understand the body starting from the here of the space. Thus, there are two interconnected inversions that Heidegger operates in relation to Husserl: In the topic of spatiality, he rejects the pre-eminence of the here; in relation to the body, he contests the primacy of tactility. Finally, the conclusion stresses that, even if the bodying forth penetrates almost all behaviour of Dasein in the world, there is however a limit of embodiment, an unreachable frontier beyond any possibility of the bodying forth, namely the understanding of being. This also implies that the problem of body needs be understood in the context of the ontological difference. (shrink)

En este entorno intangible el ser humano ya no maneja ninguna cosa. Las no cosas son aquellas cosas puramente intangibles, que no pueden aprehenderse con las manos. Lo único que le queda de las manos al (...) ser humano que habita este entorno son las yemas de los dedos con las que presiona las teclas para jugar con símbolos (Flusser, 2002: 107). ¿Qué efectos contrae este nuevo paradigma vital en el campo de la educación? ¿Qué significa educar en y trabajar con no-cosas? Este panorama plantea desafíos significativos en cuanto a la manera en que interactúan (...) con la información y cómo esta afecta sus vidas. La relación entre los medios de comunicación y los acontecimientos, además, se encuentra atravesada por el concepto de interpretación, donde la capacidad de comprender y la habilidad para reconstruir narrativas son elementos que determinan la comprensión y el sentido de lo que ocurre en nuestro mundo. Ca actor pe scena internațională, UE trebuie să facă fată noilor pericole, amenințări și provocări, cu atât mai mult cu cât urmărește să joace un rol în securitatea globală ceea ce implică asumarea de responsabilități sporite, așa cum sunt prezentate în anexă. Mediul global este caracterizat prin insecuritate, astfel Uniunea Europeană are nevoie de un mecanism complex de management al crizelor. Dezvoltarea unei astfel de capabilități atrage de la sine o altă problemă majoră, dezvoltarea unei capabilități a Uniunii. Există pericolul (...) ca această nouă capabilitate să dubleze NATO sau există pericolul ca Uniunea să își dezvolte o capacitate dar fără puterea de a o proiecta. Un conflict ce se întrevede în viitor este între președintele Consiliului European și Înaltul Reprezentant al UE pentru afaceri externe şi politică de securitate, în opinia unor eurosceptici. Dezvoltarea acestor capabilități este necesară Uniunii ce se dorește un important actor pe scena internațională. (shrink)

Pasado un siglo y medio desde entonces, el filósofo y esteta francés emérito de la Universidad de París VIII y European Graduate School Jacques Rancière, en un ejercicio característico de la filosofía de la educación, publica en 1987 El maestro ignorante a partir de la experiencia de Jacotot. New technologies such as smart sensors improve rehabilitation processes and thereby increase older adults’ capabilities to participate in social life, leading to direct physical and mental health benefits. Wearable smart sensors for home use have the additional advantage of monitoring day-to-day activities and thereby identifying rehabilitation progress and needs. However, identifying and selecting rehabilitation priorities is ethically challenging because physicians, therapists, and caregivers may impose their own personal values leading to paternalism. Therefore, we develop a discussion template consisting of a (...) series of adaptable questions for the patient–physician encounter based on the capability approach. The goal is to improve geriatric rehabilitation and thereby increase participation in social life and well-being. To achieve this goal, we first analyzed what is considered important for participation on basis of the capability approach, human rights, and ethics of care. Second, we conducted an ethical analysis of each of the four identified dimensions of participation: political, economic, socio-cultural, and care. To improve compliance with rehabilitation measures, health professionals must align rehabilitation measures in an open dialogue with the patient’s aspiration for participation in each dimension. A discussion template based on the capability approach allows for a proactive approach in patient information and stimulates a critical assessment of treatment alternatives while reducing the risk of imposing personal values. This paper argues for a revised concept of authenticity entailing two demands that must be balanced. The first demand moves authenticity from the position of a strictly self-regarding virtue towards the position of a fully social virtue, acknowledging the crucial feature of steadiness, i.e. self-consistency, as being precisely what we ‘naturally’ lack. Nevertheless, the value of personal authenticity in a modern, open society comes from the fact that it brings about not only steadiness, but also the public development of a (...) variety of existential options that can be understood as Millian ‘original experiments in living’. Thus the second demand of authenticity is a demand for ‘experimental’ authenticity which covers the whole spectrum of technologies of the self, from Nietzschean ‘brief habits’, to the use of enhancement technologies. I defend the hypothesis that the semantic paradoxes, the paradoxes about collections, and the sorites paradoxes, are all paradoxes of reference fixing: they show that certain conventionally adopted and otherwise functional reference-fixing principles cannot provide consistent assignments of reference to certain relevant expressions in paradoxical cases. I note that the hypothesis has interesting implications concerning the idea of a unified account of the semantic, collection and sorites paradoxes, as well as about the explanation of their “recalcitrance”. Having an adequate and extensively recognized resource governance system is essential for the conservation and sustainable use of crop genetic resources in a highly populated planet. Despite the widely accepted importance of agrobiodiversity for future plant breeding and thus food security, there is still pervasive disagreement at the individual level on who should own genetic resources. The aim of the article is to provide conceptual clarification on the following concepts and their relation to agrobiodiversity stewardship: open access, commons, private property, (...) state property and common heritage of humankind. After presenting each property regime, we will examine whether and how these incentivize the conservation, improvement and sharing of crop genetic resources, and conclude by defending a mixed property regime. Frecuentemente se escucha hablar de la propiedad como un derecho de dominio absoluto, algo inviolable que no conlleva obligaciones. Escribir hoy en día un libro sobre hermenéutica, que tal hermenéutica se refiera a la desarrollada por G. Gadamer en su conocido Verdad y método y que se pretenda añadir algo nuevo a lo mucho escrito sobre el tema parecería, a primera vista, empresa irrealizable. Que ambas pretensiones inspiren la sólida monografía de María G. Navarro —titulada Interpretar y argumentar— constituye empresa audaz y arriesgada, plena de coraje innovador, que provoca admiración, curiosidad e interés. Contra lo que pudiera parecer a (...) primera vista, el libro contiene un alto componente de originalidad y creatividad, debido a la estratagema metodoló-gica de que se sirve la autora. A saber, una hermenéutica in obliquo, estrategia consistente en interpretar a la hermenéutica gadameriana a través del prisma de la lógica de la argumentación. (shrink)

Given the importance of the principle of causality for the demonstration of God’s existence, this paper attempts to justify the evidence and necessity of the principle of causality, by following Fr. Fabro’s Thomistic defense—based on the notion of participation—but adding a particular emphasis on the notion of “being which is not per se,” this latter as an explanatory notion of the notion of “being which is by participation.” The introductory remarks touch upon two misunderstandings regarding the notion of participation employed (...) as a subject of the principle of causality: the first, considering “participated being” as a synonym of “received being,” and the second, the confusion, regarding the notion of being by participation, between its notional dependence on the notion of being as a whole and its real dependence on the real intensive Being. Then, in the first point, the defense of the principle of causality is distinguished from other related problems, like the particular applications of this principle. In the second and main point, we try to justify the necessity of being caused in the being which is experienced as being by participation, as follows: 1) that which is something by participation is not this something per se; 2) now, that which is not per se, either is not or is per aliud, 3) Therefore, that which is something by participation is per aliud. In the third and last point, we endeavor to justify the Thomism of our defense and of our emphasis on this notion of “being which is not per se” by considering two texts of St. Thomas. (shrink)

These thirteen paragraphs portray epistemology as the study, not directly of knowing as a human action (which could be considered the object also of anthropology) but as the study of the mode of being of the object in the subject and, in this sense, of intentional being. Moreover, intentional being is not understood as the being of the cognitional species or representation, which is real and subjective, but as the being of the known, as the presence of the known to (...) the knower (obviously, through the species but a being not reduced to the subjective being of the species): this kind of being is the proper object of epistemology. Other considerations regarding the distinction between metaphysics and epistemology take place as well. As regards the method, this essay attempts to apply Aquinas’ four steps of scientific reasoning to epistemology, in the following fashion and order: 1- Solution of the problem of the universals by recourse to the theory of the agent intellect (resolutio secundum rem); 2- Definition of knowledge as intentional possession of being (res. sec. rationem); 3- Judgment of value regarding the different instances of human knowledge or critique of knowledge (compositio secundum rem) and 4- Reinterpretation (in the light of the previous path) of common notions of epistemology, such as truth, certainty, evidence, and error (comp. sec. rationem). Open peer commentary on the article “Constructivist Model Building: Empirical Examples From Mathematics Education” by Catherine Ulrich, Erik S. Tillema, Amy J. Hackenberg & Anderson Norton. Upshot: I argue that radical constructivism poses a series of deep methodological constraints on educational research. We focus on the work of Ulrich et al. to illustrate the practical implications of these constraints.
